2.1 Nature of Services

MH Lending Services provides mortgage loan origination services for manufactured and mobile homes. We are a licensed mortgage loan originator (MLO), not a mortgage lender. Our role is to assist you in applying for and obtaining mortgage loans from third-party lenders.

Important Disclosure MH Lending Services is a mortgage loan originator. We are not a mortgage lender or bank. We do not fund loans directly. Loan approval, funding, and servicing are performed by the lender(s) to which your application is submitted. Submitting a loan application through us does not guarantee loan approval.

2.2 Services Offered

Our services include, but are not limited to:

  • Assisting you in completing a mortgage loan application for manufactured or mobile home financing
  • Reviewing your loan eligibility and explaining available loan programs
  • Submitting your completed application to one or more lenders for review and approval
  • Coordinating with lenders, title companies, appraisers, and other settlement service providers on your behalf
  • Providing required federal and state mortgage disclosures
  • Guiding you through the loan process from application to closing

TILA / Regulation Z Disclosure This website does not advertise specific interest rates, annual percentage rates (APRs), or payment examples. All loan cost information provided to you will be set forth in the federally required Loan Estimate, which will be delivered to you within 3 business days of your loan application. RESPA Disclosure

Real Estate Settlement Procedures Act (RESPA) — 12 U.S.C. § 2601

12.1 No Fees for Referrals

In accordance with Section 8 of the Real Estate Settlement Procedures Act (RESPA), 12 U.S.C. § 2607, MH Lending Services does not pay or receive any fee, kickback, or thing of value in exchange for referrals of settlement service business involving federally related mortgage loans, unless otherwise permitted by law or CFPB regulation.

12.2 Affiliated Business Arrangements

When we refer you to a settlement service provider (such as a title company, escrow officer, or appraiser), we will provide you with any required AfBA disclosure before making such a referral. You are not required to use any particular settlement service provider, and your choice of provider will not affect your loan terms.

12.3 Mortgage Servicing Disclosure

We are required to notify you of the possibility that the loan we originate for you may be transferred or sold to another loan servicer after closing. You will receive written notification of any such transfer in accordance with RESPA Section 6 (12 U.S.C. § 2605) at least 15 days before the effective date of the transfer.

14.1 Governing Law

These Terms and any dispute arising out of or related to your use of our Website or services shall be governed by the laws of the State of California (or the state where the subject property is located, as applicable), without regard to its conflict of law principles, except to the extent preempted by applicable federal law.

14.2 Dispute Resolution

Before initiating any legal proceeding, we encourage you to contact us directly to attempt to resolve any dispute informally. Please contact us at the information provided in Section 15.

14.3 Applicable Regulatory Remedies

Nothing in these Terms limits your right to file a complaint with the applicable state mortgage regulator or federal regulatory agency. See Section 15 for regulator contact information.

14.4 Venue

Any legal action arising under these Terms shall be brought exclusively in the state or federal courts located in Orange County, California, unless applicable law requires otherwise.
